These Terms & Conditions ("Terms") govern your use of the Shivasam Visuals website and the services described on it, including AI-native filmmaking, cinematic advertisements, brand commercials, music videos, VFX, and wedding cinematics ("Services"). By contacting us, requesting a quote, or engaging our Services, you agree to these Terms.
2. Services
Shivasam Visuals provides creative and production services as agreed with each client on a project-by-project basis. The specific scope, deliverables, timeline, and cost of any project will be set out separately in a quote, proposal, or written agreement between Shivasam Visuals and the client. In the event of a conflict between these Terms and a signed project agreement, the project agreement will govern.
3. Quotes, Payment & Cancellation
- Quotes are estimates based on the information provided by the client and may change if the project scope changes.
- Payment terms (deposits, milestones, final payment) will be agreed before work begins.
- Cancellations after work has started may be subject to charges for work already completed.
4. Intellectual Property
Unless otherwise agreed in writing, Shivasam Visuals retains ownership of raw project files, working materials, and unused assets. Final delivered work is licensed or assigned to the client as specified in the project agreement. Shivasam Visuals may, unless the client requests otherwise, display completed work in its portfolio and on its channels for promotional purposes.
5. AI-Assisted Production
Some or all stages of a project may involve AI-assisted tools alongside traditional film craft. Clients will be informed where AI generation forms a material part of a deliverable, and outputs are reviewed and refined by our team before delivery.
6. Client Responsibilities
Clients are responsible for ensuring that any material they provide (scripts, images, footage, brand assets, likenesses, music, or other content) does not infringe the rights of any third party, and for obtaining any necessary consents or releases (for example, from individuals appearing in wedding or event cinematics).
7. Limitation of Liability
To the extent permitted by law, Shivasam Visuals is not liable for indirect, incidental, or consequential damages arising from the use of our Services. Our total liability for any claim is limited to the amount paid by the client for the relevant project.
8. Changes to These Terms
We may update these Terms from time to time. Continued use of the website or Services after changes are posted constitutes acceptance of the updated Terms.
